1. Current Purpose of the Website

The NVOX.LIVE website currently provides preliminary information about a planned major EDM festival initiative created in connection with NVOX Foundation.

The website also allows visitors to join an email waitlist to receive future announcements and updates.

The website does not currently sell tickets, reserve admission, process payments, confirm performers, or guarantee that any particular event details will be announced or occur.

• Does not guarantee preferential pricing
• Does not guarantee admission
• Does not guarantee participation
• Does not guarantee receipt of every communication
• Does not create a contractual right to attend an event
• Does not guarantee that the event will take place on a particular date or in a particular location

The waitlist is intended only to help NVOX communicate future information to interested individuals.

4. Communications

By joining the waitlist, you agree to receive communications relating to NVOX.LIVE.

You may unsubscribe at any time by using the unsubscribe link in an email or contacting: privacy@nvox.org

Unsubscribing from marketing communications does not prevent us from sending a message where legally permitted or necessary to respond to a request, confirm an action, provide a security notice, or comply with applicable law.

5. Changes, Delays, Suspension, or Cancellation

To the extent permitted by applicable law, NVOX may:

• Change the waitlist process
• Change planned event details
• Delay announcements
• Change the event format
• Change the intended date or location

• Suspend or discontinue the waitlist
• Suspend or discontinue the website
• Delay, replace, restructure, or cancel planned activities

Nothing in this section limits rights or remedies that cannot legally be waived.

6. Acceptable Use

You may not:

• Submit another person’s email address without authorization
• Use automated systems to submit registrations
• Submit false, misleading, fraudulent, or abusive information
• Attempt unauthorized access to the website, database, systems, or accounts
• Interfere with the operation or security of the website
• Introduce malware, malicious code, or harmful content
• Attempt to bypass security or rate-limiting measures

Third-party names, logos, and materials remain the property of their respective owners.

NVOX is not responsible for third-party websites, services, availability, security, content, or practices.

We aim to keep information accurate and current, but planned event information may develop or change.

Do not rely on preliminary website content as a confirmed ticket offer, event contract, travel commitment, accommodation commitment, artist confirmation, or guarantee of admission.

Only official, final announcements issued by NVOX should be treated as confirmed NVOX.LIVE information.

10. Disclaimer

To the extent permitted by applicable law, the website and waitlist are provided on an “as is” and “as available” basis.

NVOX does not guarantee that:

• The website will always be available
• The website will be uninterrupted or error-free
• Every waitlist email will be delivered
• Joining the waitlist will provide a particular benefit
• An event will occur at a particular time or location
• A particular artist, venue, sponsor, or partner will participate

Nothing in these Terms excludes any warranty, duty, or right that cannot legally be excluded.

11. Limitation of Liability

To the maximum extent permitted by applicable law, NVOX will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to:

• Failure to receive a waitlist communication
• Changes to planned event information
• Unauthorized access caused by circumstances beyond reasonable control

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability where exclusion is prohibited by applicable consumer-protection law.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-laws principles.

Mandatory consumer-protection rights that apply under the laws of a user’s jurisdiction are not excluded by this governing-law provision.

13. Dispute Resolution and Venue

Any dispute arising out of or relating to these Terms, the NVOX.LIVE website, or the waitlist shall be subject to the exclusive jurisdiction of the state courts located in New Castle County, Delaware, and the United States District Court for the District of Delaware.

Each party consents to the personal jurisdiction and venue of those courts.

Nothing in these Terms limits rights, remedies, or legal protections that cannot legally be waived under applicable law.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

The affected provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where legally permitted.

15. No Waiver

A failure by NVOX to enforce a provision of these Terms does not waive the right to enforce that provision or another provision later.

16. Changes to These Terms

We may update these Terms to reflect changes in the website, waitlist, event plans, services, technology, or applicable law.

The updated Terms will be published on this page with a revised effective date.

Continued use of the website after an update constitutes acceptance to the extent permitted by applicable law.
